All auctions on the KubeFun platform are sponsored by KubeFun and KubeFun’s brand partners.

Welcome to KubeFun! These Terms of Use (these “Terms”) govern your use of the online interfaces and properties of KubeFun (“KubeFun”, “we”, “us” or “our”), including the KubeFun website and KubeFun mobile application (collectively, the “Platform”), as well as your purchase of, or bidding on, goods or other services offered by us through the Platform. These Terms are legally binding. Your use of KubeFun’s services constitutes your acceptance of these Terms and the KubeFun Privacy Policy incorporated herein by reference. You must complete registration and accept these Terms to use the relevant services. If you do not agree to these Terms or the Privacy Policy, you may not use any services provided by KubeFun. By registering for and using the services, you agree to be bound by these Terms and all policies and guidelines incorporated by reference.

Please read these Terms carefully before accessing the services or the Platform, or clicking to accept these Terms upon registration for using the services. These Terms have legal effect and will affect your legal rights. By agreeing to these Terms, you waive your right to sue in a court of law, your right to a trial by jury, and your right to bring any class, collective, or representative proceeding against KubeFun. As used in these Terms, the “Platform” includes all content, services, information and any components of this website and mobile application. KubeFun services refer to all services provided by us, and the Platform and services are collectively referred to as the “Services”.

By bidding on, purchasing products, or otherwise using the Services, you confirm that you have reached the legal age of majority, are capable of being bound by these Terms, and accept the jurisdiction of these Terms.

1. Eligibility

The Services are only offered to and may only be used by individuals aged 18 or over. Your use of the Services represents and warrants that: you are aged 18 or over, you have reached the legal age to enter into a binding contract with KubeFun, and you meet all eligibility requirements set forth in these Terms. You may not place orders, bid, or purchase products or services through the Services if:

1. You do not agree to these Terms;
2. You are under the age of 18, or have not reached the legal age to form a binding contract with KubeFun;
3. You are prohibited from accessing or using the Services’ content or products under applicable laws.

2. Platform Availability

KubeFun shall not be liable if all or any part of the Services are unavailable at any time or for any period for any reason. We reserve the right to restrict access to some or all parts of the Services to users, including registered users, from time to time.

When using the Services, you may spend virtual tokens such as Bids without receiving physical products. You are solely responsible for all spending, bidding and purchasing activities while using the Services. KubeFun shall not be responsible or liable for your bidding or spending on the Platform. You are also solely responsible for all products bid on or purchased through the Services. It is your sole obligation to only purchase products after you have fully read and understood the product descriptions.

3. Changes to these Terms

KubeFun reserves the right, in its sole discretion, to withdraw, change or modify these Terms, the Services, or any policies or guidelines related to the Services at any time, without prior notice. Any changes shall take effect upon posting of the revised version on the Platform. You are responsible for reviewing updates to these Terms each time before using the Services, as such changes are binding on you. Your continued use of the Platform and Services after we post such changes constitutes your acceptance of such changes. If you do not agree to these Terms or any modifications, do not register for or continue to use the Services.

4. Eligibility and Delivery Area

1. The target market of the Services is the entire territory of Indonesia, and only Indonesian residents are permitted to use the Services. KubeFun reserves the right to restrict auction access and product delivery based on the user’s country/region, which may be identified by IP address, billing address or mailing address. If your residential region is incorrectly identified, please contact us at support@kubefun.com for correction.
2. Products purchased through the Services may only be delivered to addresses within the entire territory of Indonesia. Delivery to PO Boxes or freight forwarding companies is not supported. If you wish to use an RR Box, please contact customer service to confirm before placing an order.

5. General Policies

All KubeFun policies accessible on the Platform are expressly incorporated into these Terms by reference, and you shall read each of them carefully. The procedures and guidelines below explain auction rules; the KubeFun Privacy Policy governs the collection and use of user information on the Platform; the Help section provides further details on how the Services operate; and the Platform Rules set forth important provisions governing the rights and obligations of all users.

6. Contractual Obligations

The auction process is a method by which the Platform solicits offers from buyers for the sale of items. Submitting a bid constitutes your legal offer to purchase the item. Once a bid is accepted by the system, a contract is formed between you and the Platform for the sale and purchase of the item in accordance with the terms published at the time of the auction. By bidding on an item through the Services or using the “Buy It Now” function, you agree to complete the transaction as specified and fulfill all contractual obligations.

7. System Access Rules

You are prohibited from violating or attempting to violate the security rules of the Services, including without limitation:

1. Accessing data not intended for you or logging into a server or account that you are not authorized to access;
2. Attempting to probe, scan or test the vulnerability of a system or network, or breach security or authentication measures without proper authorization;
3. Accessing or using the Services or any part thereof without authorization, in violation of these Terms or applicable laws.

You may not use any scraper, crawler, spider, robot or other automated means of any kind to access or copy data on the Platform, deep-link to any feature or content on the Platform, or bypass our robot exclusion protocols or other access restriction measures.

You agree not to interfere with the Platform, the Services or any transactions, and not to use any device, software or routine to interfere or attempt to interfere with the proper operation of the Services or any activities conducted on or through the Services. You agree not to impose an unreasonable or disproportionately large load on KubeFun’s systems or facilities. You may not upload any material to the Platform that contains viruses, Trojan horses, worms, time bombs, cancelbots or any other computer programming routines that may damage, interfere with, secretly intercept or expropriate any system, data or personal information. Violations of system or network security may result in civil or criminal liability. KubeFun may investigate occurrences involving such violations and may involve and cooperate with law enforcement authorities in prosecuting users involved in such violations.

8. Bidding Rules

1. Each KubeFun Bid is a limited, non-transferable authorization for a single auction bid only. Bids have no monetary value, may not be offset against the purchase price of products on the Platform, may not be transferred to other users, and may not be redeemed for cash or any items of monetary value.
2. As bidding may incur costs, we remind all users to reasonably control their bidding behavior and pay attention to their bidding frequency and spending.

9. Fraud and Restricted Conduct

To maintain a fair and impartial auction environment, KubeFun reserves the right to monitor and address any fraudulent or malicious conduct on the Platform. You acknowledge that you have read the prohibited acts set forth in these Terms and the Platform Rules (including without limitation) and agree not to engage in such fraudulent or malicious acts. KubeFun reserves the right to temporarily or permanently suspend any user account that engages or is suspected of engaging in such acts.

You may not register or bid under a false name or with an invalid credit card. Such fraudulent conduct violates relevant Indonesian laws and regulations. Fraudulent bidders may be reported to law enforcement agencies, and KubeFun will cooperate to pursue their legal liability to the fullest extent permitted by law.

KubeFun reserves the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order, including orders placed under the same customer account, the same credit card, the same region, or using the same phone number, billing address and/or shipping address. If KubeFun changes or cancels an order, we will attempt to notify you via the email, address or phone number provided at the time of order placement. We reserve the right to limit or prohibit orders from dealers, resellers, distributors and other users who violate these Terms.

You may not permit or assist others to use the Services for any purpose other than its intended use, or to abuse or fraudulently use the Services, including without limitation:

1. Obtaining or attempting to obtain services by fraudulent means to avoid payment;
2. Accessing, altering or destroying any information of other KubeFun users by fraudulent means, or attempting to do so;
3. Interfering with other users’ use of the KubeFun network, intentionally or unintentionally, or acting in violation of the law or in aid of any unlawful act.

All users acknowledge that the KubeFun network may only be used for lawful purposes. We reserve the right to monitor all network activities. You may not engage in the following prohibited acts:

• Maintaining more than one account, or controlling or influencing multiple accounts;
• Infringing KubeFun’s intellectual property rights, creating a competing platform, or copying Platform data for non-personal bidding purposes;
• Manipulating the auction process through fictitious bids or collusion to undermine the fairness of online transactions;
• Violating KubeFun’s policies;
• Collecting user information (including email addresses);
• Uploading computer viruses;
• Sending junk mail, advertisements, chain letters, pyramid schemes or other forms of solicitation to other users;
• Promoting illegal activities or inciting harm to others;
• Uploading or viewing pornographic content;
• Attacking others’ networks, websites or devices, or vandalizing others’ websites.

10. Prohibition on Collusion / Team Play

Any form of collusion or team play is strictly prohibited on KubeFun, including without limitation: multiple users acting together in the same auction, creating the false appearance of multiple competing bidders, taking turns bidding to earn Buy It Now benefits and then switching accounts to continue earning additional benefits for the same item.

We prohibit associated users from participating in the same auction. Participation by associated users in the same auction shall be deemed team play, and such users shall automatically forfeit their right to purchase the item, with no refund of consumed Bids. KubeFun reserves the right to implement technical measures to restrict associated accounts from participating in the same auction.

If we determine that a user is engaged in team play, we may void all their auction wins, freeze their account, and no funds or Bids will be refunded. If a user violates these Terms, they shall immediately pay for all free Bids received and used at their current selling price.

11. Account Password and Device Security

You may not disclose your username and password to any third party, and you are solely responsible for all actions under your account. Passwords may only be used to access the Services. If your login credentials are compromised or disclosed, you must immediately notify KubeFun and change your password to minimize the risk of loss. You are responsible for providing and maintaining all equipment necessary to use the Services (including hardware, software, network and communication services), and for:

1. The security of your personal information (including account, login and financial information);
2. Communication charges, long-distance fees and other related costs;
3. Any other charges resulting from the use of your account.

If you receive a remote login alert, your account may be at security risk. Please immediately go to Me – Settings – Account Security to change your password and log out from all logged-in devices. If you detect abnormal account activity, you may contact customer service to freeze your account to avoid losses.

12. Investigation of Violations

We may investigate any violations of these Terms, our policies or guidelines, and any complaints, and take any reasonable and appropriate measures to protect our systems, facilities, users and/or third parties, including without limitation: issuing warnings, suspending or terminating services/accounts, and removing or disabling access to Platform content. KubeFun reserves the right, in its sole discretion, to remove, block or edit any violating content, and may report any activity suspected of violating laws or regulations to competent law enforcement authorities.

13. License Grant

By using the Services and submitting any information or materials to KubeFun (“Licensed Materials”), you hereby grant us a non-exclusive, worldwide, royalty-free, irrevocable and sublicensable right to use, reproduce, modify, display and distribute such Licensed Materials in all existing or future media, whether now known or hereafter devised. Any Licensed Materials you provide to KubeFun shall be deemed non-confidential and non-proprietary. You warrant that you have the legal right and authority to grant such license to KubeFun, and you assume full responsibility for the legality, reliability, accuracy and appropriateness of such content.

KubeFun and its licensors retain all right, title and interest in and to the Services and all intellectual property, content and features provided through the Platform. You may only use the Platform content as expressly authorized by KubeFun, and may not:

1. Resell or commercially use the Platform or Services;
2. Collect user email addresses, information, ratings or listings;
3. Make derivative uses of the Platform and its content;
4. Use data mining, robots or similar data gathering and extraction tools.

You may only use other users’ information to the extent necessary to participate in Platform transactions and complete your involved transactions. You may not use such information for solicitation, advertising, spamming, harassment, threats, privacy invasion or other objectionable acts.

14. Content Standards

Your Licensed Materials shall not:

• Contain defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful or inflammatory content;
• Promote sexually explicit or pornographic material, violence, or discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;
• Infringe any patent, trademark, copyright or other intellectual property rights of any other person;
• Violate the legal rights of others or give rise to any civil or criminal liability under applicable laws or regulations, or conflict with these Terms or the KubeFun Privacy Policy;
• Be deceptive;
• Promote or assist any illegal activity;
• Harass, disturb or cause inconvenience to other users;
• Impersonate any person or misrepresent your identity or affiliation with any person or organization;
• Contain commercial promotions, contests, sweepstakes or other marketing content;
• Falsely imply endorsement by us or any third party.

KubeFun reserves the right, in its sole discretion, to remove or refuse to post any Licensed Materials for any or no reason. However, KubeFun cannot review all Licensed Materials before posting and cannot ensure prompt removal of objectionable content after posting. Accordingly, KubeFun assumes no liability for any action or inaction regarding transmissions, communications or content provided by any user or third party.

15. Account Registration Rules

Before using the Services, you must register a personal account and provide a password and other information required by KubeFun. Each person may only register one personal account. If it is found that an individual maintains multiple accounts, all such accounts will be immediately suspended, related auction records will be voided, and purchased Bids will be cleared with no compensation.

Your chosen username must not violate public order and morals, infringe third-party rights, or be misleading. You warrant that all registration information you provide is true, accurate and complete, and you will promptly update your account information to maintain its truthfulness and accuracy. If any information you provide is untrue, inaccurate, outdated or incomplete, KubeFun may suspend or terminate your account. If you abuse your account to harm a third party or KubeFun, we reserve the right to disqualify you and, where applicable, report the matter to competent authorities.

Accounts authorized to use the Services are non-transferable and may only be used by the authorized account holder. Unauthorized use by others is strictly prohibited. Only one login session per account may be active at any time. Except as permitted by the automatic bidding system, any full or partial transfer of an account, or proxy bidding, shall result in immediate account termination. KubeFun reserves the right to log account activity and use such logs to detect unauthorized use.

KubeFun reserves the right to temporarily or permanently suspend any violating user at any time, including without limitation for using unpaid Bids, using unauthorized bidding software, or registering multiple accounts. We also reserve the right to deactivate inactive accounts. You agree not to hold KubeFun liable for any losses resulting from such actions.

16. Bid Purchase and Payment Rules

1. All prices on the Platform are quoted and payments processed in Indonesian Rupiah (IDR). You are solely responsible for any currency conversion fees charged by your bank or payment processor.
2. You must purchase Bids before participating in online auctions. Only registered users may submit bids. Bids are sold in Bid Packs at prices published in the “Bids Store”, and must be paid in advance. A contract for the purchase of Bids is formed once Bids are purchased and credited to your account, and the invoice is due immediately. If your account is suspended for any reason, all Bids in your account will be forfeited with no refund.
3. Purchased Bid Packs are not eligible for any form of refund.
4. KubeFun reserves the right to offer discounted Bids or free Bids to specific user groups, and to remove any sign-up or promotional free Bids from user accounts at any time.

17. Bidding and Automatic Bidding

You may place manual bids by clicking the “BID NOW” button or set automatic bidding (Bidbuddy). Used Bids will be deducted from your account balance after your first Bid Pack purchase.

Automatic bidding allows you to participate in auctions while offline. The system will automatically place a bid with 1 second remaining on the auction countdown. If the auction is live and you are not the highest bidder, setting automatic bidding will place your first bid immediately.

Automatic Bidding Guarantee: In popular auctions, automatic bids set before the auction starts may not be triggered due to participant limits. As long as the bids were set before the auction began and not canceled, your participation spot is guaranteed. KubeFun does not guarantee the accuracy of the automatic bidding system and shall not be liable for system errors. Use of unauthorized bidding software is prohibited and will result in immediate account suspension.

A bid is valid only when successfully recorded by the KubeFun system, not when clicked on your device. Network delays may cause delays in bid recording, and KubeFun shall not be liable for auction delays. All bids are final, and winning bids and related fees are non-refundable.

If an auction ends prematurely due to severe third-party issues or technical failures, KubeFun may reschedule the auction and refund used Bids to all affected users.

18. Winning Limits

KubeFun reserves the right to adjust winning limits from time to time, and may restrict participation in certain auctions based on user experience, historical winning records, bidding behavior and other factors to ensure a fair experience for all users.

19. Bid Validity

Bids held in user accounts have no expiration date from the date of crediting (via purchase, redemption or auction reward).

20. Auction Rules

1. Each bid increases the item price by a fixed small amount. Your bid constitutes an offer to purchase the item. A purchase contract is formally formed when the auction ends and the final bidder completes the payment process.
2. Each new bid resets the auction countdown, the duration of which is shown in the auction details. The auction ends if no new bid is submitted within the countdown period. Automatic bids delayed due to network lag are still valid.
3. The last valid bidder wins the auction. A percentage of Bids consumed by other users may be returned in the form of designated item coupons or Bids. The auction result recorded by the system is final.
4. The Platform offers a “Buy It Now” service that returns a percentage of specified item coupons or Bids. The Buy It Now price is fixed, does not represent the retail market price, and shall not be used for price comparison.
5. KubeFun shall not be liable for Bid losses caused by third-party malicious interference with the Platform.

21. Winning Notification and Payment

1. After the auction ends, the winning user will see a winning confirmation page showing the total price, payment information and other details. You must confirm your win and complete payment as instructed; payment finalizes the win, and you will also receive a notification via email/SMS.
2. Winners must pay the full amount (auction price + applicable taxes) within 30 days of notification. Failure to pay within the deadline shall be deemed abandonment of the item, with no refund of consumed Bids. Users who select Buy It Now must complete payment within 7 days of the auction end.
3. Orders are subject to applicable taxes under Indonesian law. Taxes for auction-winning orders are calculated based on the final auction price; taxes for Buy It Now orders are calculated based on the Buy It Now price.
4. You acquire legal ownership of the item only after full payment of the purchase price and related fees. If the item price is below the statutory minimum payment amount, it will be rounded up to the minimum standard.
5. If you do not receive a won or Buy It Now item, you must submit a non-delivery claim via support@kubefun.com within 60 calendar days of purchase; otherwise, our delivery obligation shall expire and no refund will be issued.
6. KubeFun shall not be liable for lost or stolen items, but may provide logistics tracking information, purchase receipts and other materials upon request.

22. Returns and Exchanges

1. Users who win an auction and purchase the item at the auction price may return the unused, undamaged item for any reason within 7 days of receipt. Upon verification, the item purchase price will be refunded, but consumed Bids are non-refundable.
2. Users who purchase items directly via Buy It Now may return the unused, undamaged item for any reason within 7 days of receipt. Upon verification, the item purchase price will be refunded.
3. Audio, video and software products are not eligible for return or exchange once the sealed packaging is opened by the user.

23. Delivery

1. Items are delivered from partner supplier warehouses or KubeFun warehouses to the address you provide, limited to addresses within Indonesia. KubeFun may engage third parties to fulfill delivery obligations without prior notice. Any transport damage must be reported to the supplier immediately upon receipt.
2. If we are unable to deliver the ordered item, KubeFun may cancel the contract, or provide a replacement item of equal or higher value, or a gift card of equivalent value. This rule also applies to Buy It Now orders.
3. If delivered items are damaged, defective or inconsistent with descriptions, KubeFun will replace them free of charge. Returns or exchanges are not available for items shipped to freight forwarding company addresses.

24. Right to Substitute Items

Subject to the cancellation rules in these Terms, KubeFun may provide a replacement item of equivalent function and equal or higher retail price, or a lower-value replacement item at your request, or a gift card of equivalent value as an alternative solution.

25. Product Adjustment

If we are unable to provide the auctioned item due to unforeseen circumstances, KubeFun may, in its sole discretion, provide the winner with a replacement item in the same price range or credit Bids equivalent to the item’s manufacturer’s suggested retail price. If the original auctioned item is subsequently delivered, you must return the replacement item to KubeFun within 30 days at our cost.

Title to the item remains with KubeFun until full payment of the total price. You shall store the item separately and maintain insurance coverage for it. We reserve the right to retrieve the item during normal business hours.

KubeFun strives to ensure accurate product descriptions and reserves the right to correct any errors without separate notice to users.

26. Product Sources

Products on the Platform may be sourced from KubeFun’s affiliated suppliers. Product selection is based on price, user satisfaction, reviews and other factors.

27. Limitation of Liability

Under no circumstances shall KubeFun, its affiliates, licensors, service providers or employees be liable to you for any direct, indirect, punitive, special or incidental damages, including without limitation loss of profits, loss of goodwill, data loss and other intangible losses, even if foreseeable. Our maximum aggregate liability shall be limited to the actual amount paid by you for the relevant products or services purchased through the Services.

28. Disclaimer of Warranties

The Services and all content on the Platform are provided on an “as-is” basis, without any express or implied warranties. You use the Services at your own risk. KubeFun does not warrant that the Services will be uninterrupted, error-free, virus-free, or that content is accurate or complete. You are solely responsible for data backup and security.

29. Indemnification

You agree to defend, indemnify and hold harmless KubeFun, its affiliates and employees from and against all claims, damages, costs and expenses (including reasonable attorney fees) arising from: your breach of these Terms; your improper or unlawful use of the Services; your infringement of third-party intellectual property rights; or your access to the Services or access by any person using your account.

30. Termination

These Terms shall remain in effect until terminated by either party. You may terminate these Terms at any time by notifying KubeFun in writing and ceasing to use the Services. Subsequent use shall be deemed your re-acceptance of these Terms.

KubeFun may, in its sole discretion, terminate these Terms or suspend your access to the Services at any time without prior notice, including without limitation if: you violate these Terms; the provision of the Services becomes technically or commercially unfeasible; or you fail to pay any amounts due to KubeFun.

31. Dispute Resolution and Arbitration

You and KubeFun agree that any dispute arising out of or relating to these Terms that cannot be resolved amicably shall be submitted to a competent authority in Indonesia for binding arbitration under Indonesian law, in accordance with Indonesian consumer dispute rules. Both parties agree to bring claims only in their individual capacity and not as plaintiffs or class members in any class, collective or representative proceeding, and waive the right to a jury trial.

32. Governing Law

This Agreement shall be governed by the laws of the Republic of Indonesia, without regard to its conflict of laws rules.

33. Compliance and Taxes

You shall comply at all times with all applicable Indonesian laws and regulations relating to your use of the Services, bidding and purchasing of items, and shall indemnify KubeFun for any losses caused by your non-compliance. KubeFun shall have no obligation to perform any provision of this Agreement if such performance would violate any present or future laws or regulations.

34. Miscellaneous

1. No Agency: KubeFun is not your agent, fiduciary or representative. This Agreement is binding only on the parties hereto.
2. Severability: If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
3. Claim Limitation: Any claim arising out of or relating to the Platform, the Services or these Terms must be filed within one (1) year after the cause of action accrues, or be permanently barred.
4. Force Majeure: KubeFun shall not be liable for any failure or delay in performance under these Terms due to causes beyond our reasonable control, including natural disasters, fire, earthquake, governmental acts, war, terrorism, epidemics, labor disputes, communication or power outages.
5. No Waiver: No failure by KubeFun to enforce any right under these Terms shall constitute a waiver of such right.
6. Notices: We may send notices to you via your registered email or Platform announcements. You must send notices to us via support@kubefun.com or our official mailing address.
7. Entire Agreement: These Terms constitute the entire agreement between the parties with respect to the subject matter hereof and supersede all prior oral or written agreements.

If you detect abnormal account activity, you may contact customer service to freeze your account to avoid losses.
